REFUND, CANCELLATION AND EXCHANGE POLICY

1. SCOPE
This Policy governs refunds, cancellations, and exchanges in respect of tickets purchased through the platform operated by ИП Алексанян Гайк Давидович (Individual Entrepreneur Aleksanyan Gaik Davidovich) ("Tonik") at tonik.events (the "Platform"). It forms part of the Terms of Service and should be read together with the Ticket Purchase Terms and, where payment was made in digital assets, the Digital Asset Payment Terms.

Section 8 sets out the circumstances in which the law applicable to you may confer rights beyond those described in this table. Those rights are not excluded by this Policy.
3. NO GENERAL RIGHT OF CANCELLATION
Tickets are sold for a specified date or period and are not generally refundable or exchangeable at the purchaser's election.
This reflects the nature of the product. Event capacity is finite, inventory removed from sale cannot readily be resold as the event approaches, and the Organiser incurs commitments in reliance on tickets sold.
Consumer legislation in a number of jurisdictions confers a general right to withdraw from a distance contract within a cooling-off period. In most such jurisdictions, that right does not extend to contracts for the provision of leisure services on a specified date. For purchasers in the European Economic Area, this exclusion arises under Article 16(l) of Directive 2011/83/EU on Consumer Rights. Comparable exclusions apply in other jurisdictions.
An Organiser may, at its discretion, offer more generous terms for its event. Where it does so, those terms are stated on the event page and prevail over this Section.
4. WHERE AN EVENT IS CANCELLED OR CHANGED
4.1 Cancellation
Where an event is cancelled in its entirety and not rescheduled, the ticket price is refunded. Refunds are initiated once the Organiser confirms cancellation and provides settlement instructions. We will notify you at the email address associated with your order.
Refunds are typically initiated within ten (10) business days of confirmation of cancellation. The time taken for funds to reach you depends on your payment method — see Section 6.
4.2 Postponement or Rescheduling
Where an event is postponed or rescheduled, your ticket ordinarily remains valid for the rescheduled date and no refund arises automatically. Where the Organiser offers a refund election, the terms and deadline for that election are communicated to you. If you take no action by the stated deadline, your ticket is treated as valid for the rescheduled date.
4.3 Relocation
Where an event is moved to a different venue, your ticket remains valid unless the Organiser states otherwise. Where the new venue is in a different city, you may request a refund of the ticket price within fourteen (14) days of notification.
4.4 Material Alteration
Where an event is materially altered, you may request a refund of the ticket price within fourteen (14) days of notification. A material alteration means a change that substantially affects the nature or value of what you purchased, and includes:
(a) the withdrawal of a headline performer or of the principal advertised attraction; (b) a change to the date, save where you were offered and did not exercise a refund election; (c) relocation to a different city; (d) a reduction in the advertised duration or programme of more than one third; or (e) relocation of your seat to a materially inferior category or position.
The following are not material alterations: changes to supporting acts; changes to running order or set times; changes to individual members of a group; the substitution of a comparable performer where the Organiser has reserved the right to do so; and immaterial changes to the programme.
4.5 Partial Performance
Where an event begins but is curtailed after a substantial part has been performed, no refund is generally payable. Where an event is abandoned before a substantial part has been performed, the Organiser determines the entitlement, having regard to the applicable law.
4.6 Force Majeure
Where an event is cancelled, postponed, or curtailed as a result of circumstances beyond the Organiser's reasonable control — including act of God, severe weather, epidemic, governmental order, civil disturbance, or the unavailability of a venue for reasons of public safety — the Organiser's obligations are as set out in its own conditions and in the law applicable to the event. Sections 4.1 to 4.4 apply to the extent that the Organiser confirms a refund entitlement.
5. FEES ARE NOT REFUNDED
5.1 The Booking Fee
The ticket booking fee of four per cent (4%) is not refunded, including where an event is cancelled by the Organiser.
The booking fee is charged by Tonik in consideration of the booking, issuance, delivery, and support services described in Section 6 of the Ticket Purchase Terms. Those services are performed and completed at the point at which your tickets are issued, and are unaffected by whether the event subsequently takes place. The fee is therefore earned on issuance and is not returned when the underlying event does not proceed.
5.2 Payment Processing Fees
The payment processing fee applicable to your chosen method — whether card, local payment method, or digital asset — is levied in respect of the processing of your payment. That processing occurs, and the corresponding cost is incurred, irrespective of whether the event proceeds. Processing fees are not refunded.
5.2A What You Actually Receive
So that there is no doubt as to the arithmetic, a refund of a card payment returns the ticket price less the booking fee, and nothing else. Expressed as a sequence:

The booking fee is calculated on the ticket price alone. It is not applied to the payment processing fee, and no fee of ours is charged upon another.
Because the payment processing fee is retained by the provider rather than returned, a full refund of a ticket appears in card statements and in the payment provider's records as a partial refund of the original charge. This is expected and does not indicate that any part of the ticket price has been withheld.
5.3 Refund Processing Fee
Where a refund is made to a digital asset wallet, a fixed fee of 1.60 USDT is deducted from the amount refunded, to cover network transaction costs and handling.
5.4 Circumstances in Which Fees Are Refunded
Notwithstanding Sections 5.1 to 5.3, all fees are refunded in full, and no refund processing fee is applied, where:
(a) you were charged more than once for the same order; (b) you were charged as a result of a technical fault attributable to the Platform; (c) your order was declined or cancelled by us or the Organiser before tickets were issued; (d) the ticket was sold at a manifestly erroneous price and the order has been cancelled on that ground; or (e) a law applicable to you requires the return of such fees.
5.5 Important Notice Regarding Section 5.1
Consumer protection legislation in certain jurisdictions may require the refund of service fees where the underlying service is not delivered, notwithstanding Section 5.1. This is particularly relevant to purchasers resident in Australia and the European Economic Area. Nothing in this Policy is intended to exclude, restrict, or modify any such requirement, and where it applies, it prevails over Section 5.1. If you consider that such a requirement applies to your purchase, contact help@tonik.events setting out the basis of your claim.
6. HOW REFUNDS ARE MADE
6.1 Return to Source
Refunds are returned to the payment method used for the original purchase. We do not make refunds by any other route, to any other instrument, or to any third party.

Timings are indicative and are not guaranteed. Tonik does not control the systems of card issuers, banks, payment providers, or blockchain networks.
6.2 Refunds Are Made in the Currency Charged
A refund is made in the currency in which your payment instrument was originally charged, and in the same amount in that currency. Where your payment instrument is denominated in a different currency, your bank or card issuer will apply its own conversion rate to the refund. That rate may differ from the rate applied to the original charge, with the result that the amount credited to you in your own currency may differ from the amount originally debited. Tonik is not responsible for, and does not compensate for, such differences.
6.3 Digital Asset Refunds — Specific Provisions
(a) Refunds are made in the same token and on the same network as the original payment.
(b) Refunds are sent to the address from which payment was received. Where that address is not capable of receiving a return — for example, where payment was made from an exchange deposit address, a custodial account, or a smart contract that does not accept incoming transfers — the funds may be irrecoverably lost. You are solely responsible for ensuring that payment is made from a wallet you control and which is capable of receiving a return transfer.
(c) Where you supply an alternative destination address, that address is taken only from an authenticated session and never from a link or query parameter. We are not responsible for loss arising from an address you supply incorrectly. Blockchain transactions are irreversible; a transfer to an incorrect address cannot be recalled.
(d) The value of a stablecoin may differ at the time of refund from its value at the time of payment. Refunds are made in the nominal token amount, not in a fiat-equivalent amount. We do not compensate for changes in value between payment and refund.
(e) Network transaction costs are borne by you through the refund processing fee.
6.4 Cardholder Disputes
If you initiate a chargeback or payment dispute with your card issuer in respect of a valid transaction, we reserve the right to void the associated tickets and to decline to sell to you in the future. Where you believe a charge is incorrect, contacting us first at help@tonik.events is likely to resolve the matter more quickly than a chargeback.
7. DIGITAL ASSET OVERPAYMENT AND UNDERPAYMENT
7.1 Overpayment
Where the amount received exceeds the amount quoted, the surplus is returned automatically to the originating wallet address, less a handling fee of USD 1.50. Your order proceeds and tickets are issued normally.
Where the surplus does not exceed USD 1.50, it is retained and no return is made. The handling fee is fixed whatever sum the return carries, so returning a smaller surplus would consume the whole of it and deliver you nothing. We notify you by email when this occurs and state the sum retained; if you would prefer us to attempt the return regardless, reply to that email.
A surplus that is large relative to the order is held pending review under our financial crime controls and returned once that review concludes.
7.2 Underpayment
Where the amount received is less than the amount quoted, your order is not completed and no tickets are issued. However, your seat or ticket allocation continues to be held, and the checkout displays the amount received, the amount required, and the balance outstanding, together with the same deposit address to which the balance should be sent.
The balance outstanding includes a further fixed charge of USD 0.02 for each additional transfer required, because our custody provider treats each incoming transfer as a separate payment order and levies its fixed charge again. The sum displayed is the sum that completes your order.
If the balance is not received within the period stated, the order lapses, the allocation is released, and the amount received is returned to the originating address, less the refund processing fee of 1.60 USDT.
7.3 Transfers to an Incorrect Address, Network, or Token
Where you transfer a digital asset to an address other than the one generated for your order, or on a network other than the one selected, or in a token other than the one selected, the funds may be permanently and irrecoverably lost. Neither Tonik nor its custody provider is able to detect, recover, or credit such transfers, and neither accepts liability for them. Recovery, where technically possible at all, is at the sole discretion of the custody provider and may be subject to a recovery fee.
8. YOUR RIGHTS UNDER APPLICABLE LAW
Nothing in this Policy excludes, restricts, or modifies any right, guarantee, warranty, or remedy conferred on you by a law that cannot lawfully be excluded, restricted, or modified by agreement.
If any provision of this Policy is inconsistent with such a law, that provision applies only to the extent it is consistent with it, and the remainder of this Policy continues to apply.
Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Where services are not supplied with due care and skill or are not fit for purpose, you may be entitled to a remedy including a refund. Where a failure is major, you may be entitled to cancel and obtain a refund of amounts paid.
European Economic Area and United Kingdom. You retain your statutory rights in respect of services not supplied in conformity with the contract. The exclusion of the right of withdrawal for dated leisure events, described in Section 3, arises under Article 16(l) of Directive 2011/83/EU.
Thailand. Rights under the Consumer Protection Act B.E. 2522 and related legislation are unaffected.
Indonesia. Rights under Law No. 8 of 1999 on Consumer Protection are unaffected.
Russia. Rights under the Sale of Goods Ordinance (Cap. 26), the Supply of Services (Implied Terms) Ordinance (Cap. 457), and the Control of Exemption Clauses Ordinance (Cap. 71) are unaffected.
9. HOW TO REQUEST A REFUND
Refund requests should be submitted through the "my tickets" area of the Platform, or by email to help@tonik.events, quoting your order reference.
Where a refund arises from the cancellation or alteration of an event, no request is generally required; we will contact you with instructions once the Organiser confirms the position.
We acknowledge refund requests within two (2) business days and aim to determine them within fifteen (15) business days. Where a determination depends on confirmation from an Organiser, we will keep you informed of the position.
10. CHANGES TO THIS POLICY
We may amend this Policy from time to time. The version of this Policy in force at the time your order is placed governs that order and is not altered by any subsequent amendment. The current version and its effective date are published on the Platform.
